ALGA Terms & Conditions

These terms and conditions constitute an agreement between Australasian Land & Groundwater Association (ALGA) and the Corporate Partner, Delegate, Member, Sponsor or Advertiser.


Membership Terms & Conditions
  1. Members must agree to be bound by the ALGA Constitution, Membership Policy, Code of Conduct and Privacy Policy.
  2. Submission of a membership application and payment of the membership fee constitutes acceptance of the terms and conditions of membership.
  3. Members agree to join Australasian Land & Groundwater Association (ALGA) Ltd for their own personal and professional development as per the Membership Policy.
  4. Upon completion of a membership application ALGA is permitted to announce the name, company, state, and country of the member to other ALGA members.
Corporate Partnership Terms & Conditions
  1. The Partnership term and associated benefits (including membership allocations) commence upon payment of tax invoice.
  2. The Partner has the right to change membership allocations as they see fit, during the contract period. In the event a staff/student leaves the Partner's organisation part way through the term year, and has a membership allocation, the option is available to transfer the allocation to a replacement staff/student within the Partner’s organisation.
  3. The Partner needs to provide the names and email addresses of all staff who are nominated to receive a membership allocation, under the partnership package. It is agreed that, on behalf of any staff who are given a membership allocation, they are bound by the same policies as Individual Members of the Association, which are: ALGA’s Member Policy, Code of Conduct and Privacy Policy.
  4. Additional memberships can be purchased at any time over and above the package benefits.
  5. Unused benefits are not transferable to another Partnership term.
  6. ALGA reserves the right to change the benefits offered, to that of an equivalent value and will give notice in writing to the Partner.
  7. ALGA will communicate the available benefits, with the Partner, to encourage them to realise all available benefits through the partnership term.
  8. To realise the full partnership benefits Partners are to provide ALGA final logos for use, other marketing support materials, and appropriate resourcing in a timely manner.
  9. Partners agree to comply with ALGA’s guidelines for use of the ALGA logo.
  10. Any variation to partnership term must be agreed in writing.
  11. These Corporate Partnership Terms and Conditions will remain in force until cessation of the partnership term.
Delegate Registration Terms & Conditions - In-Person and Online
  1. Delegates must communicate all requirements in these terms and conditions to all within their party for whom they are purchasing registrations.
  2. Delegates must meet venue, ALGA and state government health and safety conditions.
  3. Delegates must register online and pay the registration fee in full prior to an event.
  4. Early bird rates need to be paid in full prior to the cut off date otherwise, regular rates will apply. If full payment is not received, admission may be refused with no access to any associated content.
  5. All prices listed for Australian events are in Australian Dollars and include 10% GST. Prices for New Zealand events are in New Zealand Dollars and include 15% GST.
  6. ALGA reserves the right to retain any fees charged to the extent permitted by law.
  7. Cancellation rates for Branch Events and Webinars: > 14 days - 75% refund or full credit, > 7 days - 50% refund or full credit < 7 days - zero refund or full credit (all credits are to be used within the financial year that they are given). Note: ALGA reserves the right to review its cancellation policy based on exceptional circumstances.
  8. Cancellation rates for ecoforum, symposium and training events > 60 days - 75% refund or full credit, >14 days - 50% refund or full credit, < 14 - zero refund or full credit, < 7 days zero refund and credit (all credits are to be used within the financial year that they are given). Note: ALGA reserves the right to review its cancellation policy based on exceptional circumstances.
  9. Any cancellation, change or replacement requests sent by the Delegate must be sent via email to events@landandgroundwater.com. The email must include the name, title, phone number and email address of the replacement.
  10. Any cancellation, change or replacement will not be allowed outside of item 12, unless approved by ALGA and deemed to qualify for unforeseen circumstances, including COVID related, force majeure and medical-related qualifying exclusions (personal illness or immediate family illness). Any requested refunds outside of item 12, will be at ALGA’s full discretion.
  11. Refunds, where eligible, will be processed no later than 30 days after the conclusion of an event.
  12. ALGA makes no representations or warranties as to the availability of any event sessions offered and reserves the right to change advertised programs and their respective content, dates and times, prices, venues, seating arrangements and audience capacities.
  13. Delegates are responsible for their own safety and property while attending an in-person event.
  14. Delegates agree to abide by ALGA’s Code of Conduct, and to the extent permitted by law, releases ALGA and its officers, directors, employees, consultants, licensors, suppliers, and agents from any liability for any claim, damage, injury or loss that a Delegate and/or the members of their party may suffer in relation to event attendance, howsoever caused, including without limitation due to any negligence or other act or omission of ALGA.
  15. Delegates are solely responsible for their own travel, subsistence and accommodation arrangements and these arrangements are at their own risk.
  16. ALGA reserves the right to amend event dates or venues. ALGA will not be responsible for any loss occasioned thereby.
  17. Delegates are entirely responsible for determining if their device and internet connection can successfully connect to an online stream.
  18. Delegates (and/or the members of their party) must not attend an in-person event, if they are required to be in isolation with a COVID diagnosis and/or have been directed to be in quarantine because of contact with a person with COVID and/or are awaiting COVID test results and/or if experiencing any symptoms of COVID. A proof of any of these concerns may be asked.
Sponsorship / Exhibitor Terms & Conditions
  1. All sponsorship is subject to approval by ALGA in the first instance. ALGA does not have to provide reasons for non-approval. Payment without approval does not mean acceptance. Sponsorship will come into effect upon written approval by ALGA and upon full payment of the sponsorship fee.
  2. On confirmation of the booking, ALGA will issue an invoice to the Sponsor. If the Sponsor fails to make full payment within 30 days of the due date ALGA reserves the right to make the sponsorship package available to other sponsors. If the Sponsor books a sponsorship package less than 30 days before an event, payment is to be made immediately.
  3. ALGA agrees to grant the sponsor the sponsorship rights for an event and associated benefits as outlined on the relevant web page.
  4. A sponsorship agreement cannot be cancelled by the sponsor once it has come into effect. In the event of an event being cancelled, ALGA will fully refund paid sponsorship to the sponsor within 30 days of the event being cancelled.
  5. The sponsor agrees to provide all requirements under the agreement within the time frames advised by ALGA to ensure entitlements (logos/company information/delegate registrations) are delivered.
  6. Where one party is unable to carry out its obligations under this agreement due to circumstances beyond its control or where it could not have prevented the issue, those obligations are suspended whilst those circumstances continue. Provided the other party is notified, the first party must use its best endeavours to overcome the circumstances preventing its obligations from being carried out.
  7. Each party shall indemnify the other against any claims arising from any breach of the agreement by either party.
  8. The terms and conditions of this agreement shall not be disclosed to any third parties without the prior written consent of both parties.
  9. The rights of either party under this agreement shall not be transferrable or assignable either in whole or in part.
  10. Where speaking opportunities are included in the sponsorship package, sponsors agree that if they are to promote their product, it cannot be at the detriment to any other suppliers or competitors.
  11. No sponsor shall assign, sublet or apportion the whole or any part of their sponsorship package except upon ALGA's prior written consent.
  12. Sponsorship entitlements, including organisation logo on the applicable web page and other marketing material, will be delivered only after receipt of the required payment.
  13. The Sponsor will exercise due care in and around the event venue and in all matters related to sponsorship of an event so that no harm is caused.
  14. ALGA reserves the right to refuse admission or eject the Sponsor or its representatives from an event due to (but not limited to): a. failure to comply with these terms and conditions; or b. presenting a security risk, nuisance or in any way interfering with the operation or integrity of the event; or c. presenting as a reputational risk to ALGA.
  15. If at any stage ALGA becomes aware of a reputational risk to it's brand by association with a Sponsor (i.e. a company has failed to comply with Australian law and/or act in compliance with ALGA's Code of Conduct), then ALGA reserves the right to cancel the sponsorship and remove access to all sponsorship inclusions, including branding.
  16. ALGA reserves the right to amend event dates or venues. ALGA will not be responsible for any loss occasioned thereby. ALGA also reserves the right to cancel an event or vary its hours.
  17. If ALGA postpones an event, all sponsorship will automatically be carried over to the revised event dates.
  18. ALGA is not liable to a Sponsor for any delay or failure to perform its obligations under these Terms & Conditions, if such delay or failure is due to a "force majeure event" including (but not limited to) COVID.
  19. In the event a Sponsor cancels their sponsorship, ALGA offers no refund.
Advertising Terms & Conditions
  1. ALGA will arrange for the Advertising Material to be posted on the relevant platform, as arranged with the Client, insofar as is possible. Whilst every endeavour will be made to meet the Client's wishes, ALGA does not guarantee that any advertising material will be disseminated.
  2. The Client agrees to supply to ALGA on or before the agreed delivery date, either:
    • a file containing the Advertising Material in the agreed format; or
    • if it is specifically agreed that the ALGA will create the Advertising Material, all information should be supplied to ALGA in an agreed format and medium.
  3. ALGA retains the right to omit, amend, suspend, or change the position/timing of any Advertising Material if:
    • the Advertising Material is in breach of any undertakings under these Terms & Conditions,
    • the software code associated with the Advertising Material (e.g. pixels, tags, JavaScript) or the website to which the Advertising Material is linked does not comply with the ALGA’s policies or any applicable laws, regulations and/or guidelines; or
    • where any third-party claims that any of its rights or any relevant regulations have been breached. In the event that ALGA elects to amend the Advertising Material (or the position/timing thereof), ALGA will use reasonable endeavours to consult with the Client in good faith.
  4. It is the responsibility of the Client to check upon the first appearance of the Advertising Material and to notify ALGA immediately of any errors. ALGA assumes no responsibility for the correction of errors unless notified by the Client within 7 days. In the event of any error or omission in the appearance of Advertising Material, which is caused by ALGA, ALGA will re-publish the Advertising Material (or relevant part thereof). No re-publication, will be made where the error, misprint or omission does not materially detract from the advertisement.
Presenter Terms & Conditions

As a presenter at an ALGA event, you agree to be bound by the following terms and conditions:

  1. Presentations may be audio and / or video recorded;
  2. Recordings and / or a pdf copy of PowerPoint presentations may be made available for download after the event or may be sold or provided free of charge (by ALGA) to event registered attendees and other individuals;
  3. ALGA has permission to record and distribute audio recordings, photographs, videos and any other media that contains all or a portion of any presentations, papers, hand out materials and panel discussions, without any obligation on ALGA’s part to pay fees or royalty;
  4. ALGA will be informed in writing, prior to the event, if any presentation is not to be made available for download after the event;
  5. All presentations, handouts, and related materials are either:
    • when materials used in the presentation are not the presenter's own original work or in a public domain, they are either:
      • presented with the permission of the originator/owner (to be confirmed with the submission) of the material; or
      • are believed to be within the “fair use” exemption of copyright law which includes use for purposes of criticism, news reporting, commentary, teaching, and research.
    • the presenter's own original work; or
    • available for use without permission because they are in a public domain.
  6. All information presented is either substantiated by evidence or explicitly identified as the presenter's personal opinion. In cases where evidence is not applicable or available,  it is the presenter's responsibility to clearly communicate to the audience that the views expressed are solely their own opinions;
  7. Presenters agree they will not conduct or offer any similar style presentation or lecture for a period of six (6) months before or for a period of six (6) months after the presentation date, on behalf of ALGA, to any other organisations within Australia and/or New Zealand, without specific approval of ALGA; and
  8. Presenters must register and pay prior to the appropirate event, using the discount code provided by the ALGA team.

ALGA maintains links to other web sites but makes no representations as to the accuracy of the material therein, and is not responsible for the content and conduct of these sites, nor of any goods purchased on these sites.

On-line Transaction Terms & Conditions

The following terms and conditions, along with site policies such as the Privacy Policy and other customer service policies, govern the use of the ALGA website and constitute the entire agreement between the contracting parties. By browsing the site or making a purchase, you agree to be bound by the conditions listed below as amended from time to time.

If there is any uncertainty with the terms and conditions, please contact ALGA before the completion of any purchase.

Applicable law and jurisdiction

All purchases are subject to the laws of the Commonwealth of Australia, and where applicable the state of New South Wales. By using this site you submit to the jurisdiction of the courts of New South Wales and Australia and agree that any legal action will only be commenced in these forums.

Capacity to contract

Orders can only be placed with ALGA by persons with capacity to contract, who are over the age of either 18 or 21 as legislated in your state of residence.
